This course covers the Scottish criminal and civil courts which governed our ancestors’ lives. These will include the commissary courts, Justice of the Peace court records including quarter sessions and licensing courts. Criminal courts range from the High Court of Justiciary (Scotland’s supreme criminal court) down to the franchise courts administered by the local landowner. We will also cover fatal accident inquiries.
We are more likely to discover records about an ancestor who was a criminal rather than his more law-abiding brethren. We will examine the records available to trace criminals and also touch briefly on the records of trials of Jacobites captured after the 1715 and 1745 rebellions.

This course will consider strategies that can be used to trace these movements. It will also look at the records of immigration and emigration to and from Scotland including passenger lists, registers of aliens and passports. This is also the point at which we will look at the records of those “cleared” and the various emigration societies.
